Spousal Support

Spousal support, also referred to as alimony, can be in the form of lump sum or periodic payments awarded to the financially dependent spouse when the marriage ends. The payments can be for a fixed duration or until death or remarriage. The court also has the authority to make a temporary award pending a final determination. Requests for modifications of court ordered support are also common when a change in circumstances has occurred since the award was made.

Under Virginia law, the following criteria are applied in determining spousal support:

  • Length of the marriage, education and training of the spouses, each spouse’s share of marital property
  • Age and health of the parties, financial positions, need for support
  • A spouse’s ability to pay support, contributions to the family during marriage, employment opportunities
  • Standard of living enjoyed during the marriage

Child Support

The child support determination takes into account the custodial arrangement. If the noncustodial parent has the child more than 90 days, the amount will be different than if it was sole physical custody. The court will also examine expenses such as health insurance and work-related child care costs, as well as the income — or potential income of both parties.

The court can also make a temporary award for child support pending a final determination. Child support can be modified if there has been a material change in circumstances since the award was made.
